Consumer Protection
Due to EU legislation, any consumer in the EU has the right to receive from a trader essential information that is clear, accurate, and easy to understand about a good or service before making an online purchase.
The responsibilities of ANPC, in accordance with Government Decision no. 700/2012 on the organization and functioning of the National Authority for Consumer Protection, are as follows:

Main Responsibilities of ANPC (Art. 3)
- Participates, together with other central and local public administration bodies and with consumer NGOs, in the development of consumer protection strategies, ensuring alignment with the EU.
- Ensures harmonization of the national legal framework with EU regulations in the field of consumer protection.
- Proposes and endorses draft legislation on consumer protection concerning manufacturing, packaging, labeling, storage, transport, import, marketing of products, service provision (including financial services), and prohibition of asymmetric penalties between clients and public service providers.
- Initiates, negotiates, and participates in agreements, protocols, and national/international conventions in the field of consumer protection.
- Develops procedures with other authorities regarding objectives, conditions, and cooperation in consumer protection activities.
- Participates in national and international programs on consumer protection, cooperating with organizations and institutions domestically and abroad.
- Provides periodic reports to the Government and central administration on consumer rights and interests.
- Conducts market surveillance of products and services intended for consumers.
- Controls compliance with consumer protection laws regarding product/service safety and legitimate rights, through inspections at producers, importers, distributors, sellers, service providers (including financial services), and customs units.
- Finds contraventions and applies corrective measures and sanctions; notifies prosecuting bodies in case of criminal law violations.
- Checks whether measuring instruments used on the market are accompanied by required legal documents attesting metrological verification.
- Requests suspension or withdrawal of operating authorizations, licenses, or certificates where applicable.
- Coordinates rapid information exchange nationally and internationally regarding products and services posing risks to consumers.
- Notifies decision-makers and operators in the certification system of product/service quality regarding non-conformities and proposes regulatory improvements.
- Performs sampling and laboratory testing of food and non-food products.
- Conducts consumer information, counseling, and education activities, and publishes specialized materials on consumer protection.
- Supports consumer associations in achieving their legal objectives and in creating and operating counseling and education centers.
- Supports the establishment of mediation bodies in consumer protection.
- Continuously informs consumers about products/services that pose health, safety, or economic risks.
- Receives and resolves (or forwards) complaints from consumer associations and individuals regarding violations of consumer rights.
- Provides training for specialists in consumer protection.
- Provides expert advice on consumer protection to economic operators.
- Prepares and proposes budgetary resources necessary to implement policies within its field of competence.
- Monitors compliance with advertising regulations for consumer products and services.
- Provides advice and support for the development of codes of conduct at the request of economic operators.
Additional Provisions
- (2) ANPC monitors compliance with EU regulations within its competence.
- (3) ANPC acts as the national contact point for the EU RAPEX rapid alert system regarding dangerous products (Directive 2001/95/EC on general product safety).
- (4) ANPC fulfills any other duties established by relevant legislation.
- (5) Fees and charges collected by ANPC are fully allocated to the state budget.
